Elder law:  As defined by the clients to be served, we work with people as they age, handling general estate planning issues, including making decisions about medical and life-sustaining choices.

Advance Directives:  These documents allow you to direct others on your behalf in the event you are unable to do so due to illness or other unavailability.  Whether it is for you or your children, we will help you draft a health care proxy, durable power of attorney, living will, and provide information about MOLSTs.

Guardianships:  Sometimes advance directives are not enough and an Article 81 guardianship may be necessary for a family member who has become incapacitated.  We can help you prepare and file the petition with the court.  In addition, we can help you prepare and file an Article 17-A petition for your adult child with disabilities.

 Health Care Decision-Making:  In addition to advance directives, there are other considerations that you need to make regarding your future.  For example, do you want to continue living at home?  Is an assisted-living facility a possibility for you or a loved one?  Do you need a geriatric care manager to evaluate your (or a parent’s) situation?

Long-term Care Planning:  Long-term care insurance is increasingly scarce and may well be too expensive.  We can help you find possible alternatives.

Medicare and Medicaid:  These government programs are very different, but also very important.  With Medicare, we can help you with the initial application and what you can expect.  With Medicaid, we can help you determine whether you qualify, help you navigate its rules and assist you in developing a plan for your needs.

Special Needs Trusts:  If a family member who is receiving public benefits but then inherits a large sum of money, establishing one of these trusts may be warranted.  We can help you decide whether one should be set up and, if so, in what form.

Social Security Disability Applications and Appeals:  We can help you apply for disability benefits when and if that becomes a necessity and, if you have been turned down, we can help you with your appeal.

Veterans Benefits Applications and Appeals:  Veterans are entitled to a variety of Federal benefits.  We can help you to apply for these benefits and, if necessary, assist with the appeals process.
